Products and services offered through our Design Service or Physical Manufacture may be quoted on an individual basis. Where applicable, the scope of work, price, deliverables, terms and any relevant contract will be provided separately and agreed before work begins.
Unless expressly stated otherwise, the following terms apply to products purchased through our Buildable Systems range and Digital Resources.
3. Product Information
We take reasonable care to ensure product descriptions, dimensions, images and other information are accurate.
Images, renders and digital representations are provided for illustration and may vary slightly from the final product or appearance in third-party software.
Customers are responsible for reviewing the product description and package contents before ordering.
Nothing in these terms affects your statutory rights where a product does not match its description or otherwise fails to meet applicable legal requirements.
4. Orders
By placing an order, you are offering to purchase the selected product subject to these terms.
Receipt of an order does not necessarily constitute acceptance.
A contract is formed when we accept your order and issue an order confirmation or otherwise confirm that the order has been accepted.
We reserve the right to decline or cancel an order before acceptance, including where:
- A product is unavailable.
- Pricing or product information contains an obvious error.
- Payment cannot be authorised.
- We cannot fulfil the order.
- We reasonably suspect fraudulent or unlawful activity.
Where payment has already been taken for an order we do not accept, the amount paid will be refunded.
5. Prices & Payment
Prices are displayed in the currency shown on the website or at checkout. Where currency conversion is provided, the applicable price will be shown before the order is completed.
Any applicable taxes, delivery charges or additional costs will be displayed before the order is completed where required.
Payment must be made using one of the payment methods available at checkout.
Orders may not be supplied or manufactured until payment has been successfully received unless otherwise agreed in writing.
6. Digital Products
Our digital products may include CAD files, drawings, technical information, supporting documentation, training videos, courses, templates, software, digital tools and other downloadable or online content.
The content, file formats, functionality, access arrangements and any particular technical requirements will be described on the relevant product page.
Customers are responsible for ensuring that they have suitable software, hardware, operating systems, internet access and technical knowledge necessary to access and use the digital content purchased.
Compatibility with every software package, software version, operating system, plug-in, machine, manufacturing system or third-party platform cannot be guaranteed unless specifically stated.
Software and digital tools may have particular system requirements, dependencies or compatibility requirements. Customers should review these before purchase.
Training materials, videos, courses and other educational resources are provided for information and training purposes. Individual results may vary depending on the customer's experience, equipment, software, manufacturing processes and how the information is applied.
Where software, third-party platforms or other technologies shown or referred to in training materials are subsequently updated or changed, the appearance, functionality or procedures shown in the training material may differ from later versions.
Buildable Systems Digital Content
Build packages contain digital files and technical information intended to assist with the design and manufacture of physical products.
Build packages may include Reference files intended for design, visualisation, specification and coordination purposes. Reference files form part of the Build package but are not manufacturing files and must not be relied upon for manufacture unless expressly stated otherwise.
Manufacturing drawings, specifications, technical information and other files expressly identified for manufacture should be used for manufacturing purposes in accordance with the product information and applicable Digital Content Licence.
Where a customer or third party manufactures a physical product using a Build package, that physical product is not manufactured, inspected or supplied by Digital Joinery Lab Limited unless separately purchased from us as a Manufactured product.
Nothing in this section affects any statutory rights relating to digital content supplied by us.
7. Digital Delivery
Digital products are supplied electronically using the download, access or delivery method described on the relevant product page or order confirmation.
Where digital content is available for immediate download, access will normally be provided once payment has been successfully completed.
Where digital content is prepared, customised or supplied separately, the expected delivery method and any estimated timescale will be stated on the relevant product page, quotation or order confirmation.
Customers are responsible for providing accurate contact and email information and for ensuring that they have the software, hardware and internet access necessary to receive and use the digital content.
Please contact us if you experience problems receiving or accessing a digital product purchased from us.
8. Digital Cancellations & Refunds
Consumers purchasing digital content online may normally have a 14-day right to cancel.
Where digital content is supplied or made available for download during this cancellation period, we will obtain the consumer's express consent to begin supplying the digital content before the end of the cancellation period and acknowledgement that their right to cancel will be lost once supply of the digital content begins.
Once supply of digital content has begun following the required consent and acknowledgement, the consumer will no longer have the statutory right to cancel that purchase simply because they have changed their mind.
This does not affect any statutory rights where digital content is faulty, not as described, does not conform to the contract or where a right cannot otherwise lawfully be excluded.
Where the statutory right to cancel has not been lost, any cancellation will be handled in accordance with applicable consumer law.
9. Digital Content Licence
Purchase of digital content grants you a limited licence to access and use the supplied content for the purposes described on the relevant product page and subject to these Terms & Conditions and any additional licence terms supplied with the product.
Purchasing digital content does not transfer ownership of the underlying intellectual property to you.
Unless expressly permitted, digital content must not be:
- Resold or sublicensed as a standalone digital product.
- Redistributed for general use by third parties.
- Uploaded to public or commercial file libraries.
- Published or made available for unrestricted download.
- Shared with persons who have not been authorised to use the content.
- Presented or sold as your own original digital product.
- Used to create a competing digital product, training resource, software product or digital library substantially derived from Digital Joinery Lab Limited content.
Build packages may be used for permitted manufacturing purposes in accordance with the applicable Digital Content Licence and product information. Reference files included within a Build package remain subject to any limitations stated for those files.
Training videos, courses, guides and educational materials are licensed for the purchaser's permitted use and must not be copied, recorded, reproduced, redistributed, resold or made available to others except where expressly permitted.
Software and digital tools may be subject to additional software licence terms. Where separate software licence terms are provided before purchase, those terms will form part of the contract for that software and will take precedence over this section where there is any conflict.
Except where permitted by law or expressly authorised by us, customers must not copy, modify, distribute, sublicense, sell or commercially exploit our software or digital tools outside the permitted scope of the applicable licence.
Any permitted use of Digital Joinery Lab Limited digital content remains subject to our intellectual property rights and the applicable Digital Content Licence.
10. Manufactured Products
Manufactured products are physical products supplied by Digital Joinery Lab Limited.
We may use third-party manufacturers, fabricators, suppliers or subcontractors to manufacture, assemble or fulfil all or part of an order. Unless expressly stated otherwise, Digital Joinery Lab Limited remains the contracting supplier of the product to the customer.
Manufactured products are quoted separately and are subject to the applicable quotation, specification and any separate Manufactured Product Terms & Conditions provided before the order is agreed.
Where separate Manufactured Product Terms & Conditions apply to an order, those terms form part of the contract for that Manufactured product. If there is any conflict between those terms and these general Terms & Conditions, the separate Manufactured Product Terms & Conditions will take precedence in relation to that Manufactured order.
The applicable quotation or specification will identify, where relevant, the product dimensions, materials, finishes, components, hardware, services and other items included in the supply.
Unless expressly included in the quotation or specification, project-specific hardware, accessories, installation, fixings or other components are not included.
Digital Joinery Lab Limited will comply with its applicable legal obligations relating to the safety of Manufactured products supplied by us.
Where appropriate, safety, installation, fixing, restraint, use, care or maintenance information will be supplied with the product. Customers and installers must follow any such information provided.
11. Manufacture & Installation from Digital Files
Digital files, models, drawings and technical information supplied as part of a Build package, or otherwise expressly identified as suitable for manufacture, are provided to assist with the manufacture of physical products.
Where a customer or third party manufactures a product using our digital files, Digital Joinery Lab Limited does not manufacture, supervise or control that manufacturing process and is not responsible for the workmanship or quality of manufacture, assembly or installation carried out by the customer or third party.
Before manufacture begins, the person or business carrying out the manufacture is responsible for reviewing and verifying the information supplied and determining its suitability for their particular manufacturing process and intended application.
This includes, where relevant, checking dimensions, materials, tolerances, construction methods, hardware requirements, machinery, tooling, manufacturing methods and site or installation requirements.
Digital Joinery Lab Limited is not responsible for defects, machining errors, material failures, assembly errors, installation errors or other loss or damage arising solely from:
- Manufacturing methods, machinery, tooling or processes used by the customer or a third party;
- Workmanship of the customer, manufacturer, installer or other third party;
- Materials, hardware or components selected or supplied by others;
- Alterations or modifications made to our digital files;
- Failure to follow information or instructions supplied with the files;
- Failure to verify measurements, site conditions or other project-specific information where required; or
- Failure to carry out appropriate checks before manufacture, assembly or installation.
Responsibility for ensuring that a physical product manufactured independently from our digital files complies with any legal, regulatory, safety or installation requirements applicable to that physical product rests with the person or business manufacturing and/or supplying that product, except to the extent that liability arises from digital content supplied by Digital Joinery Lab Limited and cannot lawfully be excluded or limited.
Nothing in this section excludes or restricts any liability or statutory right that cannot lawfully be excluded or restricted.
12. Third-Party Hardware & Components
Products or digital files may refer to third-party hardware, materials or components.
Third-party products remain subject to their manufacturers' specifications, installation requirements and limitations.
Unless we expressly state otherwise, reference to a third-party product does not mean that Digital Joinery Lab Limited manufactures or warrants that third-party product.
Customers should verify current third-party specifications before manufacture or installation.
13. Faulty or Incorrect Products
We are responsible for supplying goods and digital content that meet the requirements of applicable consumer law.
If you believe a product is faulty, damaged, not as described or otherwise does not conform to the contract, please contact us with your order details and a description of the issue.
We will deal with the matter in accordance with your applicable statutory rights.
Nothing in these terms limits your legal remedies under the Consumer Rights Act 2015 or other applicable consumer legislation.
14. Intellectual Property
Unless expressly stated otherwise, all intellectual property rights in Digital Joinery Lab Limited products and materials remain owned by Digital Joinery Lab Limited or the relevant rights holder.
This includes, where applicable:
- Product designs.
- Drawings.
- CAD models.
- BIM models.
- Technical documentation.
- Graphics.
- Renders.
- Photographs.
- Product descriptions.
- Manufacturing information.
- Downloadable files.
- Safety information.
- Branding.
Purchasing a product does not transfer ownership of these intellectual property rights.
Any permitted use of digital content is governed by the applicable Digital Content Licence.
15. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing excludes or limits liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Any statutory consumer right that cannot legally be excluded or restricted.
We are not responsible for loss or damage caused solely by:
- Misuse of a product.
- Unauthorised modification.
- Incorrect installation by the customer or a third party.
- Use of unsuitable materials or hardware selected by the customer.
- Failure to follow supplied instructions.
If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill, subject to applicable law.
We are not responsible to consumers for business losses arising from products purchased wholly or mainly for personal use.
16. Business Customers
If you are purchasing wholly or mainly for purposes relating to your trade, business, craft or profession, you are acting as a business customer rather than a consumer.
Nothing in these terms excludes liability that cannot lawfully be excluded.
To the extent permitted by law, Digital Joinery Lab Limited will not be liable to a business customer for indirect or consequential loss, loss of profit, loss of business, loss of revenue, loss of anticipated savings or loss of goodwill arising from the purchase or use of our products.
Our total liability to a business customer arising from a particular order will not exceed the total amount paid to us for that order, except where liability cannot legally be limited in this way.
17. Events Outside Our Reasonable Control
We will not be responsible for delay or failure to perform obligations caused by events outside our reasonable control.
Where such an event materially affects an order, we will take reasonable steps to minimise the impact and contact the customer where appropriate.
Your statutory rights regarding delayed delivery remain unaffected.
18. Privacy
Personal information is handled in accordance with our Privacy Policy.
Our Privacy Policy explains what information we collect, why we collect it, how it is used and the rights available to you.
19. Changes to These Terms
We may update these Terms & Conditions from time to time.
The terms applying to an order will normally be those in force when the order is placed unless a change is required by law or expressly agreed with you.
20. Severability
If any provision of these terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.
21. No Waiver
If we do not immediately enforce a right under these terms, this does not mean that we have waived that right.
22. Governing Law
These terms are governed by the laws of England and Wales.
If you are a consumer, you retain any mandatory protections available to you under the laws applicable where you live.
Nothing in this section prevents a consumer from using any court or dispute-resolution rights available under applicable law.
23. Contact
Questions, cancellations, complaints or issues relating to an order should be sent to:
contact@digitaljoinerylab.co.uk
Please include your order number where applicable.
24. Other Policies
These Terms & Conditions should be read together with any policies applicable to your purchase, which are available through our website.
Where a product includes additional safety, installation, care or technical information, that information should also be read before the product is used or manufactured.
